Williams to Gov. Martin [From Executive Letter Book.] Hillsborough, 27th June 1782 Dear Sir: We, last night, brought to a conclusion, after a very troublesome term, the Court of Sessions of the Peace, Oyer and Terminer, and the General Gaol Delivery held here the 17th inst., for the District of Hillsborough, and have pretty well delivered the jail by trying some and binding over to the Supreme Court the most exceptional characters and by enlisting into the Continental service, pursuant to your proclamation of the 25th ult, most of those less obnoxious. During this term seven have been capitally convicted, to-wit: Samuel Poe, for Burglary; Thomas Ricketts, Merideith Edwards, Thomas Eastridge and Thomas Dark, for High Treason; William Duke and Thomas Hunt, for Hose Stealing. And as I suppose some supplications may be made for mercy, I have thought proper to represent to your Excellency the true point of view, in which the several persons condemned, stood before the Court, the heinousness of their crimes and their moral characters in life, so that if any should be spared, you may be enabled to judge who are the less necessary victims of the policy of Law. Thomas Dark, a Captain of Fanning's, and one of his right hand men, is the principal person convicted. He has been very active and enterprising, and near as dangerous a person as Fanning himself, and from his proved inhumanity and cruelties in cutting, hacking and wounding his prisoners, had acquired among those of his own party the name of young Tarleton. Thomas Ricketts, though indicted of treason only, it is hard to mention a crime of which he is not accused, and I have good reason to believe not wrongfully. Murder, house-burning, robbery, &c., are in the black list of his crimes, to which is added a general bad character. Samuel Poe is one of eight who set out on the plan of robbery, and in one night broke open six different dwelling houses of men of property, and entered, sword in hand, and with guns and other arms, and put in fear all in the house, robbed of several hundred pounds, specie worth, of clothes, furniture, &c. Witness intended to prove the several charges, but being indicted of one, which being so clearly proved by credible Witnesses, coupled with his own confession, it was thought needless to indict him on more. (a bit more about the others) The court considering the first three proper victims of policy and the great difficulty there is of keeping them safe in jail, has ordered their execution on Friday, the first of February, only giving so much time as not to shut the door on mercy against them. The day of execution for the four latter is fixed to Friday, the first day of March next, and as they have some hope of obtaining a pardon on condition of their enlisting into the service, I believe there will not be much danger of their escaping. At this Court the Attorney-General did not attend, and the Court got the favor of Colonel Alfred Moore to officiate as Atto. for the State, and without whose assistance, which, the Court experiences in a very essential manner, they could not have carried on the business of the Court, and as he gave up all advantage of a Court, which he might have made very beneficial, I make no doubt that they General Assembly that is necessary to point out someway of ascertaining the depreciation of the small pittance granted to judges, &c., and some way for the payment of it. The present collection, I believe, is chiefly in Certificates and that is a currency which will not pass for expences. I have the Honor to be, Dear Sir, Your Most Obedient, Humble Servant, JNO. Williams * Hillsborough District is where Stephen Poe lived and where the Simon Poe family is found in the 1790 census. This must include the Haw River / Pittsboro area. Pension Application of George Waggoner George WAGGONER S4384 West Tenn. #19039, $26.66/year issued 26 July 1833. 5 Sept 1832 Franklin County, George WAGGONER aged 72 states he was born in 1760 Bucks County, Pennsylvania, according to the record of his parents. He possesses no personal records of his birth. He was at the battle of Briar Creek but was employed as a wagoner. He volunteered in Orange County, N.C., and served five months under Capt. John YOUNG and Col. SANDERS. He received a written discharge but lost it when removing to Kentucky at an earl period. His brother- in- law was Lt. Maj. in a 9 months regiment Some time in the winter of 1780/1781 he volunteered again in the same county, in a company of mounted infantry under Capt. GRISHAM, Maj. William MCCULLER and Capt. TAYLOR. Shortly afterwards he volunteered in a company of rangers commanded by Abraham ALLEN. and Lt. Joseph YOUNG. The day before Hillsborough was taken the company had a severe battle with the enemy on nearby KIRK'S plantation. LT. YOUNG was mortally wounded and soon died. This applicant was shot through the right arm a short distance above the wrist, which has troubled him much ever since. He was unable to serve for one month and then served scouring the country for Tories, " with whom that devoted section of the country was much infested." He can prove his service by Thomas KING and his brother Solomon WAGGONER. He continued to reside in Orange County until a few years after the war when he removed to Greene County, East Tennessee, where he lived for 12 or 15 years. From there he moved to Barren County, Ky., where he lived for seven or eight years. He then removed to this county 24 or 25 years ago. Thomas KING aged 64 or 65 states he was born and raised in Orange County, N.C. and was raised form his earliest recollection with the applicant and his family, their fathers lived with in two miles of one another. He has a clear recollection of the battle of KIRKS plantation, and was well aquatinted with the officers and many of the men on both sides. The company muster ground was on his father's land. Deponent removed to this county 22 years ago. Clergyman Robert DOUGAN and Capt. James LEWIS vouch for WAGGONER'S age and reputation. Larkin REAGAN states he served with WAGGONER in Capt. YOUNG'S company during the war. 26 May 1833 Franklin County, George WAGGONER, aged 72, clarifies the length of his various terms. after refreshing his memory in conversation with Thomas KING. he recalls that he served in Abraham ALLEN'S company of rangers for six months. At the time of the Commencement of his third term there were three Tories hanged at Hillboro: RICKETTS, POE AND DARK. ----------- NC-14 29 July 1782. I give and bequeath to my well beloved wife, Rhoda Poe, one negro girle named Weney, one feather bed and furniture, pigs, one desk and three plates pewter, three knives and three forks, ten barrels of corn to be paid this fives day of next December, together with one hundred acres of land on Pigs Branch where on the said Rhoda Poe formerly lived on during her widowhood. http://ftp.rootsweb.com/pub/usgenweb/nc/chatham/wills/poe001.txt All the rest of my estate to be equally divided between these my children: Sary (Sarah) Herndon, Mary Barry (Berry), Jane Madsey (Massey) and one child’s part to be divided between Mary George and Lucy Straughn (Straughan), daughters of Lucy Straughn (Straughan), deceased. Straughan (Straughn) - pair old cart wheels James Ramsey*, Administrator James Howard, Administrator W. Warden, Administrator * Sarah Howard, daughter of James Howard, married Mial Scurlock – according to other researchers. William Howard, who took in children of Stephen Poe after his death in 1773 must be related, perhaps a brother. The Howard family appears to have come from Henrico County, VA where some of the Amelia/Prince Edward County, VA Poe family can be found. James Massey was husband of Jane Poe, daughter of Simon Poe, SR Joseph Poe, son of David Poe, son of Simon Poe, JR, married Frances “Fanny” Harman. Mary Poe, daughter of Joseph Poe married James Green Caudle. Estate Papers of William Poe, deceased 1800 Unclear which William Poe this is, but the lands mentioned seem to be part of those acquired by William Poe from the heirs of John Morton in 1775 (see above). This land is adjacent to other lands belonging to members of the Simon Poe, Sr family. It would seem the elder William who acquired the lands is still alive and that this is William Poe, Jr. The fact that the heirs mentioned below are under the care of a guardian supports the notion that this is a younger man. Also it should be noted that even the ones not in the care of a guardian marry later. James C. Poe marrying Millie Bynum in 1819, for instance. And Jacob F. Poe married Rebecca Paine in 1806 and Hasten Poe married Elizabeth Paine in 1804. Elizabeth appears to have married Alexander Kinchen between 1801 and 1804. The Ann Poe mentioned herein could be the widow, but there is no direct indication who is the widow. Thanks to Joan McCarthy for supplying photocopies of these documents from which the following notes are made. Marlene Poe transcribed the “Allotment Papers” and sent photocopies from which images were made and linked to below. Inventory of the Property of William Poe, deceased Chatham County, Recorded in Book A, page 47 (the page before the account of sales so it must also be November 1801) An Inventory of the property belonging to the Estate of William Poe, deceased. December 5 (presumably 1801 as it precedes the Sales of 1801. The clerk must not have entered the data in Book A in chronological order) A notable entry mentions 17 Negroes. The inventory totals 190.16.9 Notes against the estate total 63.3.8 pounds Account of Sales of William Poe estate 1801 Recorded in Book A page from 48-52. An account of Sales of the Estate of William Poe, decd. taken 19th November 1801 Robert Thompson (son-in-law of Simon Poe, SR. Straughen, Dismukes, Kirksey married into Simon Poe family as did George and there is some family tie to Mials Scurlock) Richard Straughan George Dismukes William Kirksey Stephen Straughan Hosea Straughan William Howard (he was guardian to orphans of Stephen Poe, son of Simon Poe, SR) James Howard William Scurlock Jacob Flowers, Sr (Note that one of the heirs is Jacob F. Poe. Almost certainly the F stands for Flowers. Simon Sr’s last wife was Rhoda, whose maiden name may have been Flowers. Jacob Flowers, Jr. Hasten Poe (probably brother of Reuben C. Poe, sons of Stephen Poe d. 1824 who I believe was a son of Capt. Stephen Poe) Nancy Poe (listed as an heir) Elizabeth Poe (Betsy in this paper. By 1804 the papers state Elizabeth or Alexander Kinchen.) Emsley George Mary George John Foushe (or Fooshee) Elijah Foushe (or Fooshe) William Scurlock & William Dismukes The next page (although the pages are not numbered) is in different handwriting and states the following: The following statement is made for the express purpose of ascertaining the dividend or share of each of the Heirs of William Poe, deceased - there being seven children and Heirs, to wit, Hasten (inserted Elizabeth, Nancy) Jacob F (probably Flowers), Delilah, William & James B.* Below this statement is a summary of the estate sales totaling the sum of 192.5.8 pounds. *This looks like a “B” but is a badly formed “C” or a mishearing of the initial. Later, in the allotment papers of 1804, we clearly read James C. Poe. This is almost certainly James Cain Poe mentioned elsewhere in the Chatham County records who married Millie Bynum in 1819. Note that an 1806 court records “ordered that JAMES CAIN Poe be charged from the payment of taxes due for year 1806 for a Negro woman Joan. Exactly the same list, except for the anomalous “B” is listed as heirs to receive land allotments. Records Book A page from 53 to 56 Estate of William Poe, deceased. In account with the Administrators Along margin of last page to the left of signatures for James Taylor and James Howard is written: Taylor & James Howard - Administrators of William Poe, deceased Among those paid: James Masey (son-in-law of Simon Poe, Sr) Mary George (Mary Straughan, daughter of Richard Straughan and Lucy Poe, daughter of Simon Poe, Sr. Her husband's first name is not known to me) Emsley George's note, not recovered & costs against the administers (hmmm, maybe this is Mary's husband. Emsley is mentioned throughout these estate papers) For costs, administrators (or?) Mary George Christopher Struaghan's not, not recovered. Robert Ward Simon Poe's note to William Howard (next word looks quite like whiskey) was inventoried by the Administrators & not recorded Richard Straughan Sr William Scurlock for (can't make out) amt. forwarded. George Dismukes James Poe 26/6 . . . & costs John Fooshee Joseph Harman for hauling tobacco for receipt (note that the Harman daughters married into the family of Simon Poe, Jr's grandchildren, Joseph Poe, son of David Poe, son of Simon Poe, Jr. married Fanny Harman. A William Poe married Elizabeth Harman, daughter of Joseph Harman in Pittsoboro in 1814. William and David were probably brothers) Joseph Hackney, Sr John Hackney William Hamblet John Hatley Cash paid W(inship) Stedman as guardian (mentioned about four times) Lightfoot & Harman - their account Dr. T Terrell William Rosser Paid James Howard bal. of his acct. These large amounts seem to indicate the heirs. Elizabeth and Ann of age and some still guardians of James Howard (who must be William's son) Amount of Elizabeth Poes account 167.17.04 pounds Amount of Ann Poes account 119.11.64 pounds (in brackets) Amount of account accompany this for debts due the Estate, which are to be given over to the Guardians (plural), some of which are desperate, as therein expenses (again this indicates this is a young William who died, leaving several underage heirs. A William Poe, SR - who would certainly be the "my son William" mentioned in Simon Poe Sr's 1793 will remains in the census, denoted as William Poe, Sr. It is not known when the elder William Poe died. Perhaps this huge estate had already passed, in fact, from William Sr to William Jr) Total is 421.4.1 pounds Errors & Commissions Escepted (sic) Chatham County Nov. Many of the same names from the estate sale are here. These people are listed, among others: Due on open accounts by Robert Thompson (son-in-law of Simon Poe, SR) John Fooshe, Jr. Stephen Poe (this almost has to be Stephen Poe who died in 1824 leaving a will. My research indicates he was a son of Captain Stephen Poe d. 1773. What mitigates against this, however, is that no Stephen Poe is listed among the orphans of Capt. Stephen Poe. Either I am wrong, or Stephen Poe, Jr was of age in 1773). Christopher Straughan George Dismukes William Edwards & William Kirksey Hasten Poe, W(inship) Stedman as guardian (Hasten, son of Captain Stephen Poe, was married to Nancy Stedman, daughter of Winship Stedman. This William Poe's lands were adjacent to Hannah Poe's, the widow of Capt. Stephen Poe. The land is also referred to as lands of "orphans of Stephen Poe.” Interesting that Winship is guardian for this young Hasten. ) Section scribbled out by the clerk with a note "Returned by the Administrators for their commissions" Hard to read, but some of the names are: Bradford Howard (William Howard was guardian of Stephen Poe children, who mother was Hanna Bradford. I wonder if Hannah married William at some point?) Mary George and ___ Dismukes ___ Straughan John Morton (the senior John Morton's heirs in 1775 sold the land to William Poe who was likely this deceased William's father.) John Foushee Amounted forwarded: 525.13. 67 pounds Due on Judgments -- Amount forwarded 525.13.11 pounds Stephen & __ Straughan (Sraughn married Simon Poe daughter) Samuel Guthrie (James Guthrie was made guardian of a two year old William Poe around 1777). Stephen Neal & John Fooshee (several Neal marriages in the Simon Poe JR family and Foushee – Poe associations go back, probably to Essex County where Foushee lived across the river in Richmond County – John Foushee marred a Spoe, daughter of Charles Spoe of Richmond County, which makes one ponder records of Poe/Spoe that may be confused) This is also due from Hasten Poe for Hire of Tony and Dilee for the year 1802, 27.2.6 pounds for Rent of upper plantation same year 30 pounds. Total due to the estate 594.3.01 pounds Allotment papers The court decided to divvy up his lands by having the heirs draw lots. Each "lot" represented a tract of land that a surveyor apportioned out.
