Deed Index for first years of Caroline County is archived at the Virginia State Records Center. I examined the books on June 15, 2006. One deed appears in the index showing a transfer from Poe to Poe. No first names or exact data is shown. The page number (240) of Book One likely indicates a later year such as 1730. Benjamin Poe and William Poe are the two Poe men probably involved.

Benjamin ROW (in several records, either the court clerk or the transcriber confused Benjamin Poe and Benjamin Roe. They did exist and both had connections to families such as Dismukes (there is are Dismukes / Roe as well as Dismukes / Poe marriages.

Rebukes and fights led to scores of civil actions for slander and assault and battery. Upon the petition of James Dismukes (Desmukes) it’s orderd he have administration of the estate of Benja. Roe (Benjamin Poe?) unadministered, who with Benjamin Walker his security acknowledged bond.

 

* I had not been including records that transcribers list as “Row” since this is a surname and there was a Row family in colonial VA. However, I suspect the “Benjamin Row” and “William Row” in many of the Caroline County records around these years refer to Benjamin Poe and William Poe. If this is correct, this record reports the death of Benjamin Poe, probably the same man associated with the Samuel Poe lands The Dismukes family is often associated with the Poe family and seem to have moved near the Simon Poe SR group along the Haw River in Chatham County, North Carolina. In NC, Poe and Dismukes intermarried. This is strong reason to think this is Poe and not Row as it is easy to see a Dismukes Poe family tie around this time.

thence along the road to a bottom against Edward Herndon's and so along the Court house road to Marracosick bridge.

It’s ordered Henry Dikes, Simon Edwards, Richard Hopson, George Brassfield, James McKinny, John Gouge, John Gouge, jr., William Watson, Francis Johnson, David Tinsley, Philip Tinsley and Aron Quisenbury assist Thomas Ship in clearing the tree notched road, from Benjamin Poe’s bridge to William Watson’s*, and also making the bridge by Poe’s.

 

* William Poe and William Watson attained a joint Patent in Orange (later Culpeper) County one month later, June 1737.That Benjamin Poe's bridge and William Watson's here in Caroline County are near each other, certainly indicates a close relationship between these men..One would think that this Benjamin is a brother to William Poe who had wife Lydia.

This record associates the William Watson family with Benjamin Poe. William Watson and William Poe jointly acquired a land patent in “Culpeper County.”

Suit on the attachment. William Daniel agt. The estate of James Hearn. It’s considered by the Court that the plaintiff recover 771 pounds of tobacco. The constable made return he executed the attachment in the hands of Samuel Edwards, John Powell, Benjamin Poe, John Bradley, Phillip Tinsley, John Beasley, Chas. Beasley, John Robinson, Josias King, William Watson and Daniel Johnson. Charles Beasley declared he has in his hands belonging to Hern 117 pounds of tobacco. It’s ordered he pay the same to Daniel and that the other persons pay to Daniel what shall appear (before William Taliaferro Gent.) to be in their hands.

Action of Debt.. George Goodloe Gent, late Sheriff of Caroline Co. agt. John Allmond, John Sutton, Samuell Coleman and Robert Tompkins, Robert Williamson, and Henry Burk. It seems to the Court that the plea of the defendants are good and sufficient in law to preclude the Plaintiff from maintaining his action. It is considered the Plaintiff should take nothing. The Plaintiff appealed to the eight day of the next General Court, who with Zachary Lewis Gent, his security acknowledged their bond.

On the petition of Robert Baber setting forth that he built a water grist mill on the Long branch in this county apprehending that the land on both sides the said run where he dam was to join belonged to the petitioner, but it appearing on a  late survey that part of the dam and the land adjoining on one side belonged to William Cruchfield of this county, the petitioner applied to him to sell him an acre for the support of his mill, but Cruchfield refused to sell. It's ordered that Head Lynch Gent., John Sutton and John Johns view and lay off an acre of Cruchfeild's land adjoining to the dam and if it take not away housing, orchards or other immediate conveniences to value the same and put Robert Baber in possession thereof.

Note: The above record is the only record anyone has found associating Simon Poe (SR) with the name of a woman named Sarah. This record does not at all make it clear that Sarah is Simon’s wife. As his wife, would her payment not be included with his? It seems that these separate payments indicate that this Sarah Poe is, in fact, someone other than the wife of this Simon Poe.

 

This record is cited as proof that Sarah was Simon’s wife by McDonald Poe, deceased, of Waldron, Arkansas, in his self-published book of 1975 entitled, Biographical Studies: Samuel Poe of Essex County, Virginia, Family Lineage in United States of America 1704-1975. On page 92 of this book, the author claims that a 1743 Caroline County court record mentions that Simon Poe and Sarah Poe serve as witnesses on a case. Then, on page 97, he presents a garbled transcription of this record.

Zachary Lewis, attorney to our Sovereign Lord the King, gives the commissioners to understand that Sam, a  Negro man slave belonging to Joseph Stevens, on 10 November 1743, one cotton gown of the value of fifteen shillings current money, the proper gown of Catherine Richards, did steal. Sam on his arraignment pleaded not guilty. Catherine Richards and Harry a Negro man belonging to Philip Herndon were examined. It is the opinion of the Court Sam is guilty. The prisoner prayed benefit of the Act and it is considered by the Cout that the jailor burn Sam in the left hand and accordingly Sam was burned in the hand in open Court.

 

(Sam’s troubles were not over)

 

Zachary Lewis …. Informs that Sam and a Nego man slave belonging to Joseph Stevens of said County on 10 January 1743 [1744] in the day time between the hours of seen and ten of the clock of the same day, the mansion house of Thomas Harriss of the said county with force and arms feloniously did break and enter and then and there one pair of cloth breaches and one piece of meat of the value of six shillings did take, steal and carry away. Sam on his arraignment pleaded that he was guilty of stealing the breeches but no guilty of stealing the meat or breaking the house. Thomas Harriss and Jack, a Negro man belonging to George Braxton, Gent. were examined. It is the opinion of the Court that Sam is guilty of breaking the house and stealing the breeches of the value of ten pence and that the Sheriff give Sam at the common whipping post 39 lashes well laid on and then Sam is discharged.

Scire facias sued out by James and Robert Berries merchants in Glasgow to renew a judgment agt. John Sutton* 9 Aug. 1746 for pounds 8.90.11 - current money and 160 pounds of tobacco also 15 shillings or 150 pounds of tobacco for an attorney's fee and costs. The sheriff made return he caused Sutton to know by Samuel Pow and Nicholas Oliver and the defendant did not come. It's considered judgment be renewed for the debt and costs (italics added).

 

* Samuel Poe sues the estate of John Sutton in 1753.  Another John Sutton (Junior?) is associated with the death of Richard Bradley, associated with the Poe family.

Petition. William Johnston etc. executors of Samuel Coleman* agt. Mersam Poe. Judgment is granted the plaintiffs for pounds 2.16.6 current money.

 

*Coleman’s executors also sue Simon Poe on 11 July 1751. Marsom Poe appears still to live in Caroline County, and perhaps near or with Simon Poe.

Gambling

Virginia laws forbade wagering on cards and dice in taverns, but since magistrates, in precinct courts, had jurisdiction to punish violators the only cases of record in the Order Books are appeals to the county court. The only statutes controlling betting away from the taverns until the rule of the Committee of Safety were laws which prohibited “excessive” gambling. (Campbell describes a case involving Rodham Kenner II, the outcome of which is not known).

With the rule of the Committee of Safety public officials tried to break up gambling in homes. They twice summoned Rodham Kenner II to appear and answer charges, and summoned William Murray, Joseph Cooper, John Cooper and William Poe* to appear against him.

Action of debt. Coleman's executors agt. Simon Poe, the defendant not appearing judgment is granted agt the defendant and James Taylor Gent. Sheriff for pounds 4.12. - unless he answer the suit.  

 

 

13 December 1751

Action of debt Samuel Coleman's executors agt Samuel Poe and Simon Poe. The defendants not appearing, the judgment of last July court is confirmed agt. them & James Taylor Gent, late sheriff, for pounds 34.12.11 current money, to be discharged on the defendants' paying pounds 17.6. 5 1/2 with interest from 17 June 1749

Suit on Attachment. Roger Madison agt. the estate of John Wright. The plaintiff proving his account. judgment is granted him for pounds 7.12.11 current money. The Sheriff served the attachment in the names of James Jemison and Samuel Poe. Poe declared he had 105 shillings which he ordered to pay the plaintiff. Jemison declared he has a hogshead of uninspected tobacco which when inspected he is ordered to deliver to the Sheriff to sell.

Matthew Boyle agt. Thomas Pannel. on an attachment. Judgment is granted the plaintiff for pounds 13.15.8 current money. It's considered by the court that the plaintiff recover the money and his cost. The Sheriff made return that he attached in the hands of William Poe and William Poe being sworn as garnishee declares that he has in his hands of the defendant's estate pounds 9. It's ordered that the garnishee deliver the same to the Plaintiff and he be discharged.

The last will and testament of Richard Bradford was presented in court by William Bowler and proved by Thos. Mason, Henry Farley, and William Ragsdale, witnesses thereto. Racheal Bradford, executrix in the will named, by a note from under her hand relinquished her right of executorship and Stephen Poe, executor, relinquished in open court. On William Bowler's motion, administration of the estate with the will annexed is granted him.

It's ordered William Bowler, administrator etc., pay Henry Farley . . . Thomas Mason  . . . William Ragsdale [each] 280 pounds of tobacco for one day's attendance and coming and going once eighty five miles to prove the will of Richard Bradford.

* Without evidence that I have seen, many researchers claim that Simon Poe had a wife named Sarah and that she was a Bradford. It is interesting to note the name Sarah Bradford here. She is  not listed in the will as a sister or daughter.

* "Sophia" Poe, wife of Simon Poe, JR, whose brother Captain Stephen Poe is married to her sister Hannah.

John Sutton b. prior to 1711, d. Caroline, son of John Sutton md Sarah _____ and had William, John, James, Stephen and Joseph. He was Church Warden, St. Margaret’s Parish in 1741. His will was probated in Caroline in 1785. He was a Justice in Caroline in 1758, see. Order Book, 1755-58, page 39.

 

Cumberland County

A few records for Cumberland County are included because of the mention of John Sutton “of Caroline County” and the fact that Cumberland County is adjacent to Prince Edward County, an area where we find a Robert Poe by 1749 and a Samuel Poe by 1751. A link between Robert Poe and Samuel Poe and the Poe family of Essex / Caroline County has not been discovered. The Samuel Poe who arrived in Prince Edward County in 1751 cannot be the one mentioned in these records as the one here continues appearing in the records for Caroline County after 1751.

William Powe produced a certificate from Robt. Gilchrist Gent., for taking up a runaway Negro man named Arthur belonging to Rice Curtis, Gent. of Spotsylvania County. Ordered to be certified to the Assembly.

 

Others “producing a certificate” for other “runaway negros” includes Alexander Loggie, Joshua Grady and Richard Edmundson. No other business this day except these.

Note the record of 1754 where Marsom Poe witnessed a transaction in Spotsylvania involving a Coleman. An interesting possibility. The family name “Marcom” appears in Caroline County. One has to wonder if this first name reflects a marriage into that family.

Welfare

Campbell erroneously identified this man as a member of the Poe family. The original record as transcribed by Dorman makes no mention of the Poe surname. The man was simply John Blaikey.

 

 

From Campbell

The church wardens did a certain amount of welfare work in spite of their preoccupation with the enforcement of the laws governing religious worship. Following are the cases they took charge of in Caroline from the records in the Order Books:

 

1761 – Curtis and Peter Poe, the sons of John Blaikey Poe bound because their father neglected their education.

This record cited by Campbell is not in the “court order books.” There may be an apprentice list that has not bee published or that the libraries I perform research in do not have in their holdings. Still, no “Price Poe” appears anywhere else that I have found. My suspicion is that Price is the last name as I do find the surname Price in Caroline County at this time. John Beverly Roy also appears in a few records unrelated to this one. There seems to have been “Roy Tobacco Warehouse”. Richard Roy and Simon Miller were inspectors there in 1765.

The Court are of the opinion that the sum of ten pounds be paid to John Hoomes, Gentleman, for the use of Benjamin Poe, as compensation for his trouble and expence in maintaining his sick son* while on Furlough from the Army of the United States.

 

* This passage appears unclear. Was Benjamin Poe being compensated for caring for the sick son of John Hoomes? Or compensated, through John Hoomes, for "maintaining" his own son, Virgil, disabled at The Battle of Germantown. Perhaps Hoomes was a local official charged with dispensing government reimbursements. The words "maintaining" and "sick" appear problematic to the understanding of the court order. Why would the government not just “pay” the money directly to Benjamin Poe? While the records for a wounded “Hoomes” has not been checked, Virgil Poe (who appears in Amherst County and then Franklin County, KY with a Benjamin Poe) was indeed wounded around the time of this payment.

Note: The Battle of Germantown took place in October, 1777. Virgil Poe could be the son of this Benjamin Poe who received compensation for "maintaining his sick son." This Benjamin Poe and wife Elizabeth sold land in Spotsylvania County (where Virgil enlisted) in 1772 and moved (back?) to Caroline County. A Benjamin Poe and Virgil Poe appear in Amherst County in 1785. There is some possibility that Benjamin Poe dies soon thereafter and that his wife Elizabeth Poe is “bondsman” for a daughter’s marriage:

The Last Will and Testament of Rebecca Bradley deced. was proved by the Oaths of two witnesses and ordered to be recorded. Peyton Stern, the Executor therein named having refused to take upon him the execution thereof. On motion of William Poe who took the Oath prescribed by Law. Certificate is granted him for obtaining Letters of Administration on the said Estate with the Will annexed. Bond acknowledged and ordered to be recorded

Musco Garnett and Mungo Roy. Executors of James (blurred by erasure). Plaintiffs against John Evans and William Poe. Defendant  In Debt  The Defendants Evans failing to appear on the motion of the Plaintiffs by their Attorney it is considered by the Court that the Plaintiffs recover against the said Defendant and Elijah Jeter the security for his appearance the Debt in the Declaration mentioned and costs unless the said Defendant should appear and answer at the next Court. The former Process in this suit not being executed on the Defendant Poe. On motion of the Plaintiffs by their Attorney, it is considered by the Court that the Plaintiffs have a new Writ against the said Defendant.

William Poe, Plaintiff against John Long defendant On Petition  The Defendant failing to appear tho solemnly called on the motion of the Petitioner by his Attorney it is considered by the Court that the Plaintiff recover against the said Defendant three pounds fourteen shillings and six pence. Also his costs in this behalf expended. And the Defendant in mercy &c. But this Judgment except the costs is to be discharged by the payment of one pound, seventeen shillings and three pence with legal interest thereon after the rate of five per centum per annum from the twenty first day of June on thousand seven hundred and eighty three till paid.

John Sutton b. prior to 1711, d. Caroline, son of John Sutton md. Sarah _____ and had William, John, James, Stephen and Joseph. He was Church Warden, St. Margaret’s Parish in 1741. His will was probated in Caroline in 1785. He was a Justice in Caroline in 1758, see. Order Book, 1755-58, page 39.
