Samuel Poe land along the Peumansend.  Land sold to Samuel Poe by Matthew Collins in 1707 is described as being “105 acres, part of 4200 acres granted to John Medows and Henry Petars by patent 17 April 1667 in St. Ann’s Parish . . . Mr. Macco’s land on the west side of the south fork of Pumansend Swamp.” Also in 1707, Matthew Collins and Mary his wife of Essex County sold to Paul Micou 406 acres described as “part of 4200 acres formerly granted John Meaders and Henry Peters by pattent 17 April 1667 in St. Mary's Parish . . . . John Elllit's land . . . south side of a branch of the south forke of Pewmansend Swamp . . . “

 

Samuel Poe’s lands fell within St. Mary's Parish in Essex County and was on the south side of a branch of the south fork of the Peumansend

 

The name Peumansend Swamp refers to a section of Mill Creek, or to Mill Creek as a whole in some references. The term “swamp” is not used literally. Swamp simply means “branch” of the waterway, according to Colonial Caroline: A History of Caroline County, Virginia by T. E. Campbell and published in 1954.

 

There is at least one mention of a Samuel Poe and a William Poe in Essex County, Massachusetts

Reading dates from this period is difficult. March 25th was the beginning of the legal or civil year.  Some sources help by stating a date such as April 1, 1707/8. That notation indicates that the calendar date is 1708.  The "Sparacio" books cited below transcribe the records as written.

NOTE: Although this probably is not a misreading of “Poe or “Pooe” and perhaps should be “Poole” no records for this or a Simon “Poole, etc.” have been located. Note that a James White is in several Caroline County court records in the 1730s. Examples: 4 October 1738 At the motion of Simon Po, he is allowed for four days attendance & for twenty five miles coming & going four times having sworn to the time as an evidence for James White agst Joseph Brock Gent, it is therefore ordered that the sd White pay the sd Po two hundred pounds of Tobacco for the same as the Law directs. * The Daniel family is related to the Poe family of Amelia / Prince Edward County, which has yet to be connected to the Poe family of Essex/Caroline County. Also note that close ties connect the “George” family with the family of Richard Straughan to Lucy, the dauther of Simon Poe SR. Simon Poe SR was born around the time of these deeds in 1707/8. He died in 1793 in Chatham Co. NC. It is not known if Simon Poe SR is truly a son of this Samuel Poe but is surely close kin. Also, we do not actually known where Simon Poe SR was born nor do we know where he was raised and educated. This is true of all these early Poe men and the women mentioned later (Katherine Poe and Sarah Poe).

February 9, 1707, and Samuell Poe was a witness to its execution in Deed Book D and C 13. Court Records of Essex County, Virginia

 

"This Indenture made the ninth day of February in the year of our lord One Thousand Hundred Seven and Eight by and between Matthew Collins of the county of Essex on the one part, and Robert Marshall of the same county on the other part. Witnesseth that the said Matthew Collins for and consideration of the sum of fifteen pounds of Sweet Scented Tobacco and cash to him in hand paid by the said Robert Marshall before the ensealing and delivery hereof the receipt whereof he the said Matthew Collins doth hereby acknowledge have granted, bargained and sold and by these presents doth grant bargin, sell unto the said Robert Marshall his executory, administrators and assigns fifty acres of land it being part of a devident of four thousand two hundred acres formerly granted John Meadows and Henry Peters by patent dated April the 17: 1667 it lying and being in the Parish of St. Mary's and County of Essex aforesaid bounded as followith -- Vig: Beginning at a corner red oak and Hickory of Samuell Poe's land by a branch, running thense south eleven degrees east one hundred and fifty poles to a corner gum on the north side of the south fork of Pumansend Swamp, thence down the swamp, its several courses brought straight is north fifty one degrees east one hundred and fourteen poles to three gums corner to Samuell Poe's land at the corner of a branch, thence up the branch, it's several courses brought into a straight line is north fifty-seven degrees west one hundred and forty two poles, joining to the land of Samuell Poe to the beginning place etc."

Sidebar: McDonald Poe, in his book Samuel Poe of Essex County, assumes, upon an erroneous reading of some records, that Mary, the wife of Matthew Collins, was Samuel Poe’s daughter. This deed clearly puts the matter to rest. Mary Collins was the “only daughter and heire apparent of Henry Peters” the co-owner of the Meders/Peters grant and probably the source of Matthew Collins ownership of a considerable portion of the land that see him selling through a series of deeds.

On the second day of November, 1680, he (Augustine Hermen) presented a petition to the governor and council of the province, in which he recites that one "George Holland, with other envious persons, had coveted, and were gone about privately to take away part of his children's land in Bohemia upon false allegations and untrue bounds." These false allegations appear to have been, that the metes and bounds of Bohemia Manor and Bohemia Middle Neck enclosed a great many more acres of land than the patents called for. The petition recites that he had obtained a warrant for a re-survey, and that the deputy-surveyor, one Joseph Chew, after he had surveyed the land and made a plot of it, for which (Augustine) Hermen paid him nineteen pounds of tobacco, had run away; that he had kept a plot himself, which he had returned to the office of Mr. Painter, who, it would seem, was at that time in charge of the surveyor-general's office, and who had promised to send him a new patent in consideration of six hundred acres of land which he had relinquished to him for it.  etc.,  etc. etc.

* This researcher doubts this is Samuel Poe. No other record refers to him as “Captain” nor misspells his name as such. Curiously, even this author does not index the name according to the spelling here, but was if it is “Pew” a – name that did exist in Essex County. Also, there is a Captain Rowzee that one sees in the records and cursive R and P from the time was difficult to distinguish between. This may be Pew or a misreading of shorthand for Row or Rowzee (Row was present also in the area). Regardless, this record adds little to our knowledge of whoever it is.

* A William Poe married Frances Winslow - various researchers have produced conflicting genealogies for this William Poe. At any rate, the Winslow family clearly is in Essex County and also the part of Orange County that became Culpeper County at the time we find this Poe family in the area. Meadows and Henry Peeters and bounded as followeth beginning at the mouth of a branch called Francis Browning Branch at the main run side of the South Fork of Puemansend Corner to the Iron Mine Land and running Easterly up the said Branch its several courses to three marked white oaks standing in Matthew Collins old division line. This indenture made the Sixteenth/seventeenth day of June 1726 Between Jonathan Fisher of white haven in County of Cumberland in the Kingdom of great Brittain marriner and William Smith of Southfarnham Parish in County of Essex Witnesseth that the said Jonathan Fisher for sum of Five and twenty pounds Currt money of Virginia and one thousand pounds of good & merchantable Tobacco by these presents doth confirm unto said William Smith his heirs the land & plantation containing one hundred acres being the Land formerly sold by Mr. William Johnson of Rappahannock County unto one Robert Thomas Browning & by the said Browning unto one David Hopkins & one Robert Prater & by the said Prater & by the Prater & Richard Mackabun given unto one Richard King & by the said King sold unto one Leonard Chamberlin & by the said Chamberlin unto the above William Johnson & by the said William Johnson given unto his daughter Susanna formerly the wife of Benja Fisher deced from whom the said Jonathan is descended and is their only heir at Law which said land begins at a deep Branch that runs through the land of William Johnson issueing from the creek that runs up to the land of one Nicholas White the said branch extending it self South & West unto the woods from thence to a small branch that runs out of the branch aforesaid & croseth the Path that leads to a plantation of one Robert Youngs & by severall other courses until it compleats the said one hundred acres of land reference unto the former & antient deeds and Sales being had the said land being now bounded by the lands of William Johnson. ----- Whatever put William Poe in debt, it is interesting that it involves the Edwards family, involved in the Samuel Poe sattle stealing incident. And this is happening within a year of Samuel Poe’s death. One might consider that Benjamin Poe is seeming more mature and taking on more responsibility – as in the petition above. Benjamin is established such that the court even refers to “Benjamin Poe’s bridge”

To my son John the lower part of my land whereon my dwelling house standeth from the corner at the fork of the bever dam branch up to the three notched road to a line of tree of mine and John Sanders . . . next to my plantation . . to the head of a small branch comeing out of the southermost for and of the said bever dam branch bein the bounds between me and Mathew Collins. To my son John a feather bed bought of John Vawter and the green rugg and blanketts and bolster and pillows and a pair of sheets and his choice of my two guns and my great bible and all my carpenters, joiners and coopers tooles, and a young cow and calf, when he shall come to be eighteen years of age, at which time he shall be for himself. To my son Samuell all the rest of my land that is above the line of marked trees, and abovesaid small branch and the abovesaid three Notched road. To my son Samuell by best millpuff bed, bolster and pillows and the best spotted rugg and a pair of blankets and a pair of sheets and my other gun and my family book and my pickett prayer book and my smallest chest and a young cow and calf when he shall come to be eighteen years of age, at which time he shall be for himself. These my two sons when they shall arrive to the age of fourteen years have each a year's schooling given them to learn them to write and sypher and their schooling be piad for out of the rest of my estate that is not given to them. In the attachment obtained by John Getar agt. the estate of Robert Poe (spelling this way in original) , (10/24 written in margin) William Thomas failing to make out his claim to the 2 cows, a two year old heifer & one yearling heifer. It is therefore ordered that the Sheriff get the sd. cattle appraised & deliver the same to the Plt. or so much thereof as will satifie & pay ye Balla. of ye Judgmt. which ye sd Plt obtained agt the sd deft. on ye 17th Day of January last and sd attachment is dismist.

 

Francis Starn making oath that he attended eleven days as an evidence for John Getar on his Atta. aft the estate of Robt. Poe (Poo in original) ye sd John is therefore ordered to pay sd. Francis for his eleven days attende. according to law with costs. (eleven days – this much has been quite an issue)

 

 

-- it is ordered that John Getar pay John Griffin for two days attendance as an evidence agt. Robert Poe .
