Edward Watts 1650-1728 Spotsylvania County (There seems to have been some close relation between the Poe and Watts families in Spotsylvania and Orange/Culpeper area

 

Introduction:

 

Mossum Poe (aka Marsom Poe, Massam Powe, Marsom Powe - most common spelling for last name is Poe).

Mossom Poe seems to have been illiterate (at least he signed by mark of "x") and this must be why there are so many variations of his first and last name.

 

Simon Poe, Samuel Poe (JR) and Benjamin Poe all have some connection to Spotsylvania County. We also find Mossum Poe (aka Massom Powe and Marsom Poe). Certainly these men are relations. The "Mersam Poe" mentioned in Caroline County court records for 1749 must be the same man who later appears in Spotsylvania.

 

Mossum Poe must have been born before 1728 (so he could be son or grandson of Samuel Poe of Essex County). If this is the person listed as "Miriom Poe" in Caroline County court records for 1739 (admitted a strange variant of the name, if it is), then Mossum Poe was born before 1718, and is almost certainly a son of Samuel Poe of Essex County. It appears that no son of Samuel Poe had reached the age of 21 by the time Samuel Poe died in 1725.

 

Thomas Powe, son of Mossum Poe, seems to have intentionally altered the spelling of the last name - his reasons unknown.

 

John Sutton

Some close relationship exists between the Poe and Sutton families. Records for the Suttons are included herein so that this relationship may become clearer. One John Sutton, Gent died 1731 (see below) 

 

Francis Browning

Francis Browning administered the estate of Samuel Poe who died in 1725. A particularly close relationship therefore existed between the Poe and Browning families. Records for Browning are included here in hopes the relationship will become clearer.

This indenture made this fourth day of May in the year of Our Lord one thousand seven hundred and twenty four by and between Francis Browning of the County of Essex and Parish of Saint Ann of one part and Edward Rowzee of the same County and Parish of the one part; Witnesseth that Francis Browning in consideration of one shilling to him in hand paid by Edward Rowzee have and by these presents do bargain and sell unto Edward Rowzee his heirs all the parcel of land containing by estimation two hundred and fifty acres of land and bounded lying on the North side of the Mattapony in County of Spotsylvania and Parish of Saint George, Beginning at two red Oaks and a whit Oak on the North side of a Run, thence North eight degrees West thirty six poles to a red Oak by a Great Stone, thence North fifty degrees West sixty poles to a white Oak saplin, thence South  thirty degrees West two hundred poles to a red Oak thence South ten degrees West on hundred and seventy six poles to a Gum and a Burch at the mouth of the Branch it first began at being part of a devident of land granted to Larkin Chew for two thousand acres and binding on the land of Francis Smith and on the land of John Blanton and on the land of William Bartlett sold out of the same and shall fully include two hundred and fifty acres of land, To have and to hold the tract of land and all appurtenances unto Edward Rowzee his heirs from the data of these presents during the full term of one whole year from thence next ensuing paying therefore the rent of one ear of Indian Corn at the Feast of Saint Michael the Arch Angel only if lawfully demanded to the intent that by vertue of these presents and of the Statute for transferring uses into possession take a release of the inheritance thereof to him and his heirs, In Witnsess whereof the parties to these presents have hereunto set their hands and seals the day and year above written.

This Indenture made this fifth day of May in the year of Our Lord one thousand seven hundred and twenty four by and between Francis Browning of County of Essex and Parish of Saint Ann of one part and Edward Rowzee of the same County and Parish of the other part; Witnesseth that Francis Browning in consideration of the sum of fourty pounds of current money to him in hand paid by Edward Rowzee the receipt whereof he doth hereby acknowledge, have and by these presents do bargain and sell unto Edward Rowzee his heirs all that tract of land containing by estimation two hundred and fifty acres and bounded. In the action of Debt brought by John Sutton, Plt. against Samuel Ham Defendt, for Eight hundred and thirty pounds of tobacco, the Defendt. haveing pleaded payment & submitted the same to ye court for tryall, who after haveing heard all arguements on each side are of oppinion that Forty three pounds of tobacco is due on ballance. Therefore Ordered that ye said Ham do pay unto said Sutton the said sume with costs and an attorneys for alias Exo.

For One thousand two hundred fifty & four pounds and a quarter of tobacco Judgment last Court being granted against said Defendant and Henry Berry his Securety for what should appear due p enquiry the same being put to a Jury p name,  William Hackney, Richard Sharp, Abraham Brown, Thomas Parkes, Samuel Bartlett, William Brandourn, Daniell Huff, Peter Russell, Thomas Allen, Benjamin Cave, Thomas Phillips & James Roy who after being sworn brought in their verdict in these words Wee of the Jury find for the Plantife One thousand two hundred and fifty four and one quarter pounds of tobacco damage, Daniel Huff, foreman; which motion at the Plantifes motion is admitted to record and Judgment granted for the same with costs & an attorneys fee. - In the action of Trespass between MARY CURTIS. an Infant by RICE CURTIS JUNR. Gent.. her next friend. against HENRY FRANKLYN alias HARRY LONG Deft. for Ten pounds Sterling damage, issue being joyned and a Jury sworn by name EDWARD HERN­DON JUNR. &c. who having heard the Evidences and arguments on behalf of each party retired & after some time returned the following verdict, vin., We find the day and year aforesaid at t.he Parish & County aforesaid the sd Deft. did ride ye Gelding aforesaid andthat he then & there knew him to be the PIts. & borrowed him of one JOHN KING to ride as aforesaid, And if the Law be for the Pit. we find for him Fifteen shillings current money damage; otherwise we find for the Deft.. Benjamin Wood also compensated for testimony & travel of 23 miles coming and going four times.

The Last Will and Testament of Amey Sutton deced being exhibited & sworn to by Edmund Waller the Executor therein names & was proved by the oaths of Edmund Waller & Samuel Brown, two of the witnesses to the sd. Will, and the sd. Executor having taken the oaths as the Law directs & entered into Bond with John Waller Gent. His security & acknowledged the same in Court, Certificate is due form is granted him Huddleston, William Bradburn & Robert Wills or any three of them being first sworn before some Majestrate of this County do appraise all such of the sd deceds. Estate as shall be produced and shewn to them by the sd Executor & make report of their proceedings therein to the next Court.

It is ordered that he be fined Five shillings current money or fifty pounds of tobacco for the same and in case of non payment or giving sufficient caution for the paying thereof at the laying of the next Parish Levy, then to be levied on his goods and in case no such distress can be made, then he is ordered to receive on his bare back Ten lashes at the Publick Whipping Post for the sd Offence

1798 Tax List for Berkeley Parish mentions locations. Joseph Herndon, for instance, who is associated with “Mossom” Poe lived near Snell’s Bridge.

In the name of God Amen I John Chapman of the Co. of Spotsylvania and Berkley Parish being sick and weak of body but perfect sense and memory and calling to mind the uncertainty of this life do make this my last will and testament hereby revoking all other wills heretofore by me made in manner and form following: First, I resign my soul into the hands of the Almighty God and my body decently buried at the discretion of my executor hereafter mentioned d o give and dispose of my worldly estate as the Lord has been pleased to bless me with as follows:

Item: I give unto my son Edward Chapman forty-five pounds current money to him and his heirs forever.

Item: I give unto my son James Chapman thirty-four pounds current money to him and his heirs forever.

Item: I give unto my son Benjamin Chapman forty-seven pounds current money to him and his heirs forever.

Item: I give and bequeath unto my son Thomas Chapman fifty-five pounds current money and my riding horse to him and his heirs forever.

Item: I give and bequeath unto Allen Chapman fifty-five pounds current money to him and his heirs forever.

Item: I lend unto my beloved wife two Negroes, Daniel and Pegg during her natural life and after her decease to be equally divided amongst her five children (to wit) Allen, Robert, Erasmus, Thrashley and Sarah but in case either of them should die without issue or arrive at the age of twenty-one that then his or their part to be equally divided amongst the survivors-

 

Item: I lend unto my beloved wife during her natural life my dwelling house with two hundred and fifty acres of land adjoining thereunto but in case she should agree for it to be sold with my other lands then it is my desire she should have two hundred and fifty pounds current money to purchase another place either of which after her decease to be equally divided amongst all my children (to wit) William, Edward, Mary, James, Benjamin, Thomas, Allen, Robert, Erasmus, Thrashley and Sarah but in case either of them should die without issue or before they arrive to twenty-one years that then it is my desire that his or their parts should be equally divided amongst the survivors and their heirs forever.-

 

Item: My will and desire is that all the rest of my estate both real and personal shall be sold by my executors hereafter mentioned and the money arising thereon to be equally divided among all my children (to wit) William, Edward, Mary, James, Benjamin, Thomas, Allen, Robert, Erasmus, Thrashley and Sarah, and their heirs forever, but in case either of them should die without issue that then it is my will and desire his or their parts should be equally divided amongst all the survivors and their heirs forever-

A codicile to the above will. It is my desire that my loving wife shall set as an executrix if it should be her desire.

At a court held for Spotsylvania County on Thursday 21st March 1776.

 

This will was proved by the oath of Vincent Vass and Thomas Chapman two of the witnesses hereto and ordered to be recorded and on the motion of William and Benjamin Chapman the executors therein named who made oath thereto and together with James Duncanson, Gent. and Henry Gatewood their security's entered into and acknowledged their bond in the penalty of three thousand pounds as the law directs certificate is granted them for obtaining probate thereof in due form.

 

TESTE

Know all men by these presents that we William and Benjamin Chapman and James Duncanson and Henry Gatewood are held and firmly bound to Fielding Lewis, Charles Dick, Robert Chew , Edward Herndon and Mann Page, Jr. Gentlemen justices of the court of Spotsylvania County now sitting in the sum of three thousand pounds to the payment whereof will and truly to be made to the Ed. Justice their. . . . We bind ourselves and each of us and each of our heirs extrs. and Admrs. jointly and severally firmly by these presents. Sealed with our seals this 21 st of March in the year of our Lord one thousand seven hundred and seventy six and in the sixteenth year of the Reign of Our Sovereign Lord George III.

 

The condition of this obligation is such if the above bound William Chapman, Benjamin Chapman Executors of the last will and testament of John Chapman deceased do make or cause to be made a true and perfect inventory of all and singular the goods and chattels and credits of the said deceased which have or shall come to the hands, possession or knowledge of the said William Chapman and Benjamin Chapman or into the hands and possession of any other person or persons for them and the same so made do exhibit in the county court of Spotsylvania at such time as they shall be there unto required by the said court and the same goods, and chattels and credits and other the goods and credits of the said deceased which at any time after shall come to the hands, possession or knowledge of the said William and Benjamin Chapman or in to the hands and possession of any other person or persons for them as will and truly administer according to law and further do make a just and true of their actings and doings therein when there to required by the said court and also shall well and truly pay and deliver al l the. . . .

That your Petitioners Labour under a very great Hardship in being obliged to travel, Some Twenty odd & others thirty Miles, to attend General Musters, which are Constantly appointed at the Courthouse in Fredericksburg. Situate on Side of the Count. First I give to my daughter Lucy and to heirs forever my negro man Croe also her choice of my beds with its furniture also my Roan mare with a blazed face and saddle and bridle also my seal'd skin Trunk

            Item It is my will that all my stock of horses cattle sheep and hogs be equally divided amongst all my children except the mare before given to my daughter Lucy

            Item It is my will that if my children should not agree in the devision of my stock in that case I desire they should be sold for the most that can be got and the money receiving therefrom to be equally divided among my said children.

            Item I give to my son Thomas Powe all the land and premises I now live to him and his heirs forever provided he will let my daughter Lucy live with him as she hath neither to live with on otherwise it is my will and desire that my said daughter Lucy shall have and enjoy half my sowed land including the horses during her natural life but after her deceased it is my will that my said son should enjoy it as aforesaid

Septr. 15, 1796. John x Hackney, deed of trust to Jedediah Johnston, Thomas Hackney, Thomas Hackett and Jno. Sutton, to secure payment of all just claims, etc., after securing creditors, if Negroes should remain unsold, then “to my son Thos. Hackney, 3 negroes; to my son Richard Hackney, 2 negroes; to my son Robert Hackney, 2 negroes; to my daughter Frances Johnston, 2 negroes.” The sd. Negroes subject to being hired out “for the support of myself and my wife Jane Hackney, during our natural lives,” etc., etc. Witnesses, Martin Davenport, Stephen Hackney, Wm. Arnold.
