Culpeper County, Virginia formed from Orange County. Legislative enactment in 1748. Organized in 1749. Later changes occurred in 1832-1833. Francis Browning

Three Francis Browning names appear in the historical record. The eldest seems to be Francis Browning  (1672-1723). His son was Francis Browning (c1696-1775) and his son was Francis Browning (died 1760). Independent confirmation of these dates has not been accomplished. These three men will be referred below, at times, as Francis Browning i, ii, or iii

 

The eldest Francis Browning appears to have been married to Rachel. The next one administered the estate of Samuel Poe (d. 1725). Browning researchers claim the wife was Francis Browning was a member of the Lloyd family. The third Francis Browning was married to Frances Norman and is connected to the family of William Poe (whose wife was Lydia).

The Browning Family. By Judge D. A. Grimsley

The Brownings appeared in Virginia soon after the settlement of the Colony. One of them, as appears from Henning's Statures, was a member of the House of Burgesses, but whether the Culpeper family is a descendant of this man is not definitely known.

 

Francis Browning settled near Gaines X Roads (Gaines Crossroads – my addition), now Rappahannock, in 1735. He is supposed to have come from Caroline county. One Thomas Browning also came to Culpeper about that time, but returned to Caroline.

 

The wife of Francis Browning was a Miss. Lloyd*, of Maryland, and they had the following

children: 1. Francis m. Frances Norman;

2. Nicholas, m. Sarah Washburn;

3. John m. Miss Demorest;

4. Jacob m. Elizabeth Bywaters;

5. Mary m. Courtney Norman;

6. Ruth m. William Duncan;

7. a daughter m. ----- Turner.

 

* No supporting evidence is provided for this claim. The Lloyd family was in Caroline County early in the century. Other Browning researchers seem to point to this statement by Grimsley in their family histories. Without other evidence, though, it seems as likely that the wife of Francis Browning (ii) was a daughter of Samuel Poe. This would explain why Francis Browning administered Samuel Poe's estate. Francis Browning and Samuel Poe lands were adjacent in Essex/Caroline County. William Poe and Francis Browning land were adjacent in Culpeper County. These two families appear so close that some kind of kinship must exist somewhere.

*Note that six months after receiving the patent in Orange County William Poe and wife Lydia dispose of their land in Caroline County. William Poe appears to have been present, but his wife, Lydia Poe, was represented by Benjamin Robinson by virtue of power of attorney.

In August, 1670, Francis Lederer had explored the area from the Great Fork, the juncture of the Rappahannock and Rapidan Rivers, to the Blue Ridge, and marked trails. In the mid 1700's, William Poe, who had land in the upper reaches of Battle Run as far back as 1737, and lived near Gaines Cross Roads, laid off a road which roughly followed Lederer's Trail. It is represented by the present Route 637 from Route 211 west  of Amissville to a sport near Wakefield Manor on Route 522 between Flint Hill and Huntly. The road from Washington via Fodderstack staying west of present Route 522 to the connection with Poe's road and continuing to t he top of the mountain, was Chester's Road, named for Captain Thomas Chester who owned property west of the Gap which bears his name.

... Sandford's Mill, also known as Cooksey's, was on the Jordan west of Poe's Road, while Water's Mill was down near the mouth, east of the road.

A piece of Poe's Road has been cut out now and it turns, hitting Route 522, opposite Wakefield Private School. About two miles below Chancellor's Mill on the Rappahannock County side, was Lewis' Mill, near the mouth of Buck Run as it came in from Fauquier. This as fairly close to Poe's road, and was reached by a short section of road that is now closed.

We are now down to Water's Mill, already mentioned, on the east side of Poe's Road on the Jordan River. Next comes the intersection of Poe's Road, Route 637, with Crest Hill Road, Route 647.

 

Below Keysville (Lotte, or Larrabee's Kennels) about a half mile down on Hungry (Hunger) Run, and on the east side of Poe's Road was Poe's Mill. Then, down about the mouth of Hungry Run as it goes into the Rappahannock was old Parker's Mill, served by Parker's Mill Road.

In the Name of God Amen December 22d 1748. I Thomas Watts of St. Thomas’ Parish in Culpeper County Planter being in sound and Perfect Health of mind and memory.. and as touching such worldly Estate. I hereby make my last Will and Testament.. Imprimis I give and bequeath my Soul to Almighty God that gave it me and my Body to the Earth to be buried.. Item I will and desire that my wellbeloved Wife Esther shall live on the plantation I now live on if she be the longest liver and have One hundred acres adjoining with Timber and Wood for the use of the Plantation for and during the time of her widowhood and no longer and at the time of either her Death of Day of Marriage that then the said Plantation to return to them as shall be hereafter mentioned Item I give to my son Edward Watts the Plantation he now lives on with the Tract of land thereto belonging Estimated Two hundred acres.. Item I give and bequeath to my Son John Watts the Plantation he now posseth with the lands bounded accordingly estimated Two hundred acres be the same more or less.. Item I give to my Son Benjamin Watts* the Plantation commonly called the Schoolhouse with the tract of land bounded on James Barbour and John Watts so up the great branch including the land between them Bounds and Bland Ballards line Estimated Two hundred acres more or less.. Item I give to my son Thomas Watts the Plantation known by the name of John Stones Plantation with the tract of land adjoining thereunto containing by Estimation One hundred eighty three actress be the same more or less and bounded on Bland Ballards line James Barbours line and Dixon’s line..Item I give and bequeath to my son Jacob Watts a Tract of land containing by Estimation One hundred and fifty acres b the same more of less and bounded between Bland Ballards, Benja. Watts.. Item I give to my Daughter Sarah Watts a tract of land containing by Estimation One hundred and fiftey actress be the same more or less bounded between James Barbour, Joseph Rogers, Dixon’s line .. Item I give and bequeath after my Decease and the Decease or day of Marriage of my Wife Esther the abovementioned plantation I now live on with One hundred acres of land thereunto adjoining and bounded on the River and running to Benjamin Caves line on the River then along Capt. Benjamin Caves line to my back line as far as to include One hundred acres which said Plantation Land I give to my Son Wm. Watts after my Decease and Decease or Day of Marriage of my Wife Esther.. Item I give and bequeath unto my Daughter Esther Watts a tract of land containing by Estimation One hundred actress and bounded between the land belonging to the Manner Plantation and John Watts land Item I will and desire that after my Decease my Still be to the use of my Wife Esther during her widowhood and all my children in General that is to say my son Edward, my Daughter Ann, my Son John, my Daughter Elizabeth, my Son Benjamin, my Son Thomas, my Daughter Sarah, my Son Jacob, my Daughter Esther, my Daughter Mary, my Son William, my Daughter Frankey which said Still shall be to their use and if any benefit or income shall accrue by the said Still the same shall be equally divided amongst y above mentioned Wife and children and if my wife should either marry or die or any of the above said children should die then the Still shall be amongst the remainder of my children and the income of the said Still shall be equally divided between such of my above mentioned Sons, John Watts and Benjamin Watts to be my Sole Executors of this my last Will and Testament.. This last will and Testament of Thomas Watts deceased was this day exhibited in Court by John Watts and Benjamin Watts the Executors therein name

 

 and at a Court continued and held for the said County on Friday the 16th day of March 1749 Edward Watts the Heir at Law of the Decedent personally appeared in Court and declared he had no objections to make against the Proof of the said Will Whereupon the Court proceeded to examine the Witnesses upon Oath to wit .. whose depositions are hereunto annexed and ordered to be recorded with the said Will and on the motion of the said Executors Certificate is granted them for obtaining a Probat thereof in due form they having sworn to the same and given Security in the Penalty of One thousand pounds according to Law

 

March 16, 1749

Robert Sherman, William Twyman & George Twyman the Subscribing Witnesses to the will of Thomas Watts decd being examined touching the said Will upon their oaths severally depose as follows, the said Robert Sherman saith that he wrote the Will of the Testator at his request and by his direction left a large blank space therein, and that the Testator executed the same presence of all the subscribing witnesses leaving the same space blank and that about thirteen months afterwards the Testator directed the Deponent to insert the two last clauses in the said Will to wit, a Devise of One hundred acres of land to his Daughter Esther Watts, and a Bequest of the profits of his Still to his Wife and children, and that he believes the two other subscribing witnesses were ignorant of the two last mentioned clauses being inserted they not being present at the  time And the said William Twyman & George Twyman severally depose that they saw the Testator Execute the Will produced and that he was then in his perfect sence and memory, but they believe the two last clauses were not inserted when they became witnesses but say there was a blank space left and were informed that the said two last clauses were inserted afterwards by Robert Sherman the other Subscribing witness & further they say not.

This is also were we find a Benjamin Poe who claimed birth in 1749 in Culpeper County in a pension application. Freeman connects to Poe at least in Alabama and Nall and Poe marry in Alabama and prior to that were in Anson Co, NC together. Samuel Parks is found in Caswell County, NC. Elizabeth Parks married a John Poe

Norman (c.1720 - c1770) in Culpeper County. His will was probated March 13, 1770 in Culpeper County, mentioning his wife and children. He was a son of Isaac Norman and Frances Courtney, and a brother of Frances Norman who marred his wife's brother, Francis Browning. Mary Browning was the daughter of Francis Browning, Jr. 1696-1775 (who administered the estate of Samuel Poe).

FAUQUIER DURING THE PROPRIETORSHIP by H. C. Groome

p. 206

Watts' ordinary, a place of more importance, is shown by Dalrymple as twelve miles north of Neavill's [ordinary], where the village of Delaplane now stands. It ras kept by Thomas Watts, who was granted a license by the Prince William court in 1753 'for the ensuing year'. There is no record of the license being continued by the Fauquier court, but that Watts' house remained a local landmark is shown by the fact that John Wood in 1761 was appointed surveyor of the road from 'Watts to the head of  Goose creek', and again in the same year, 'from 'Thomas Watts to the Top of the Ridge on the Manassas Road'. The road thus indicated was obviously the road from Delaplane leading up Goose Creek to its source in the Manassas gap of the Blue Ridge.

The Morgan family were neighbors of the Poe family on Newhope Creek in Chatham Co, NC in the later 1700s. Sarah and Mariam Rosty Reynolds married brothers William Threet Poe and Thomas Poe in the mid-1800s, probably in Pickens Co, Alabama. It is unclear if the Culpeper County Reynolds family is the same surname. Reynolds also was present in Anson County, NC where my family lived prior to moving to Alabama. William Threet Poe was my great-great grandfather.

This day came the Plt. by his attorney and Edward Thomas and Reuben Daniel come into Court and undertake for the Deft. that in case he should be cast in this suit that he should pay the condemnation of the Court or render his body in Prison in discharge thereof or that they will do it for him, and the Deft. again failing to appear, it is considered by the Court that the Plt. recover against the Deft. eleven pounds and a penny current money, the Debt in the Declaration mentioned, and his costs by him about his suit in this behalf expended and the said Deft. in mercy etc. But this Judgment, [except as to the costs] is to be discharged by the payment of four pounds and a penny  from the 17th day of June 1760 to the 16th day of November 1762 and Interest on the said four pounds and a penny from the last mentioned day till paid.

Isaac Roberts, James Wheately, William Picket Junr., Baily Johnson, Thomas Watts, John Rosser, William Duling, William Allan, William Norman, Jacob Weaver, John Wheately and Clement Norman, who being elected tried and sworn the Truth to speak upon the issue joined upon their Oaths do say that Deft is guilty in manner and form as Plt against him hath declared and they do assess Plts. damages thereof to Forty shillings besides his costs. Therefore it is considered by the Court that Plt. recover against Deft. his damages aforesaid in manner aforesaid assessed and his costs by him in this behalf expended and the Deft. in mercy &c.

On motion of Frances Browning, for a Rolling Road through the land of John Cooper, this day the Viewers made their  report, whereupon the Petitioner prayed to have a review of the same. Ordered that the same Viewers, to wit, William Johnston, Junr., William Duncan, John Roberts and Reuben Slaughter or any three of them being first sworn before a Justice of the Peace for this County do view the several ways proposed from her Plantation into Road and make report of the conveniences and inconveniences it may be to the Public, the said Cooper or any other person to the next Court

In the name of God Amen. I Thomas Watts of Culpeper County  and in the Parish of St. Marks being of perfect mind & memory and known the uncertainly of this Mortall life and recommending my soul to Almight God and beging Pardon for my sins when I shall live Mortall life And I do dispose of my Personell Estate in manner and form as followesth. Item I give and bequeath unto y son William Watts won Iron bound chest and won hundred and twenty five acres of land joining with the South prong of my Wife Eliz. Watts. Iikewise to Richard Watts the son of William Watts on Smith bore gun I likewise give and bequeath unto my son Thomas Watts won hundred and twenty five acrers of land adjoining to the plantation wareon he now lives to him and his Haires lawfully begotten of his body but not to be fully possest with till the Decease of my wife Eliz. Watts, I likewise give my Brother William Watts won hundred acreres of land lying on the west side of the Pattin and on the west side of the Malee Road Joyning to the Plantation Whereon he now lives, I likewise give unto my beloved Wife Elizabeth Watts to hold during her life my plantation stock good chattels and all my possessions acknowledging her to be my whole and sole Execr. & Administrator of this my last Will and Testament. I give unto my Daughter Elinor Cox fivety acres of land Joyning to the North East corner as the lone goes to her and her heirs forever lawfully begotten of her body. Item I likewise give unto my son William Watts the Plantation whereon I now live after the decease of my wife Elizabeth Watts and after her decease the goods and chattels stock and whatever shall be pertaining after her decease shall be equally divided among the five children. [only four are listed unless the Joel Watts who signed below is the fifth child]

 

I do hereby acknowledge this to be my last will and Testament making all other Wills that hath ben heretofore made Voide and of none affect but this to be my last Will & Testament and in Witness whereof I have set my hand and seal this Twenty fiveth day of January in the year of our Lord Seventeen hundred and Sixty and in the first year of the Ragne of our Soverin Lord George the Third Witness my hand & seale.

The last Will and Testament of Thomas Watts decd was exhibited to the Court by Elizabeth Watts the Executor therein named and was proved by the oaths of Henry Bennett & Joel Watts Witnesses thereto and ordered to be recorded and on the motion of the said Executors certificate is granted them for obtaining a Probat thereof in due form she having sworn to the same & given Bond & security according to Law.

John Gore being in a weak and low state of health. .

Unto my grandson Reuben Gore son of my daughter Mary Gore one cow and calf the cow big with calf.     .

            To my son John Gore one shilling sterling money of Great Britain in lew of his equal part of my estate it being all I intend him.

            Unto my loving wife Mary Gore during her life or widowhood all the remainder of my estate not already willed away but after marriege or death then (except my land) to be equally divided between my four children and two granachildren (vizt) Henry Gore, Joseph Gore, Mary Breedlove, Sarah Oneal, Reuben Gore and Rachel Parks. If my well beloved wife se cause (before her death) she may appoint my son John Gore one equal part with my other four children and two grandchildren.          .           .

If Daniel  Welsh a mulatto now in my service shall well behave during the life of my beloved wife and never seek his freedom he be free after her decease.

.           To my son Joseph Gore after the decease of his mother my plantation whereon I now live over and above his part already given.

            I do hereby constitute and appoint  my well beloved wife Mary Gore executrix and my son Henry Gore executor.          .

            To my beloved son Robert Slaughter one tract of land lying on Flat Run cont ining about two hundred and fifty acres, where­ on my son Willlam now lives. .

            To my beloved son Thomas Slaughter the sum of twenty shillings current money.

            To my beloved  on William Slaughter and Francis Slaughter to be equally divided between them the tract of land whereon my son Robert and my said son Francis now live, each of my said sons William and Francis, to have the places on which they settled, that is to say my son William to have that which is now in property of.my son  Robert and my son Francis the place whereon he lives.   .           .           .

            To my son James Slaughter all the tract or parcel of land whereon he now lives.

            To my son Lawrence Slaughter all the tract or parcel of land whereon I now live and likewise one hundred acres joining the same, lying in the south side of Mountain Run after the decease of my beloved wife to whom I leave the said last mentioned lands for and during her natural life.

            To my beloved son George Slaughter three tracts of land in the north side of Mountain Run viz. the land which I bought of Mr. Gabriel Jones, which he bought of Col.Charles Carter and to others joining there.

            To my beloved daughter Susannah Lightfoot twenty shillings current money.     .

            To my grand daughter Mary Slaughter, daughter of my son Thomas, one Negro girl named Charity. .

            My will is that all and every of my. sons and my daughter Susannah Lightfootand their heirs shall have and enjoy all the Negroes, sums of money or other things (moveables) of which kind soever given or lent them by me at any time hereto­fore and that the same shall not be accounted as any part of my estate at my decease.  ,           ,           .

            I lend to my well beloved wife Mary for and during her natural life all the residue of my estate not herein before mentioned; and after the decease of my said Wife, to my son, George Slaughter six Negroes viz Val, Nan, George, Moses, Milly and Eve, and to my son Lawrence Slaughter three Negroes viz,  Austin, Agnis and Easther, and to my daughter Martha Jones, I lend five Negroes viz Ned, Robin, Alice, Judith and Dick, it being especially my will that the said Negroes or any of them or any of their increase shall not be disposed of by my said daughter or her husband otherwise than to the heirs of her body, and in case my said daughter Martha should die "without issue of her body, then the said Negroes and their increase shall return and be accounted as part of my estate, and more­over my said daughter Martha is to have no other part of my estate. And after the decease of my wife, all the residue and romainder of my Negroes, stock, and household and kitchen furniture, utensils, money, outstanding debts, etc. shall be equally divided between all my children, except my son George and my daughter Martha Jones.

            It is my desire that my estate shall not be appraised.

            I do hereby constitute, nominate and appoint my well beloved wife Mary sole executor.

On the motion of REBECCA BRADFORD, it is ordered that WILLIAM NASH pay her 9ne hundred and five pounds of tobacco for three days attendance, coming ten miles and returning, as a witness for him and his Wife against WILLIAM HAMILTON (other records in this period mention Daniel Bradford and William Bradford).

*Jonathan Poe and Samuel Poe (see above). Mary Browning (c.1720 - after 1779) married January 21, 1737/8 in Orange County to Courtney C. Norman (c.1720 - c1770) in Culpeper County. His will was probated March 13, 1770 in Culpeper County, mentioning his wife and children. He was a son of Isaac Norman and Frances Courtney, and a brother of Frances Norman who marred his wife's brother, Francis Browning. Mary Browning was the daughter of Francis Browning, Jr. 1696-1775 (who administered the estate of Samuel Poe).

This indenture made the ( ) day of August 1774 Between Charles Browning Heir at Law and Frances Browning Administratrix with the Will annexed of Francis Browning deceased of the County of Culpeper of one part and James Browning of the county aforesaid of the other part Whereas said Francis Browning deceased possessed in fee simple a tract of land whereon James Browning now lives containing Ninety acres and bounded Beginning at two red oaks on the head of a Branch of Battle Run and runing thence South to a white oak thence South West to the beginning and whereas the said Francis Browning did by his last Will and Testament among the records of said County Court of Culpeper direct that all his estate real and personal should be sold at the death of the said Frances his Widow and the money arising to be equally divided between his children and Whereas the said Frances and her children the heirs of teh said Francis Browning did commence a friendly suit in the County Court aforesaid whereby it was by the consent of the parties ordered that all the Estate of the said Francis Browning deceased should be sold by the said Charles Browning as heir at Law and Frances Browning as Administratrix under the Will and that they convey the same to the purchaseer4s whereby by force of which decree they are impowered to convey the aforesaid tract of land unto the said James Browning in consideration of the sum of Fifty pounds current money of Virginia paid by the said James Browning hath conveyed a tract of Ninety acres of land unto the said James Browning

This Indenture made this Fifteenth day of August 1774 Between Charles Browning heir at Law of Frances Browning Administrix with the Will annexed of Francis Browning deceased of the County of Culpeper of one part and Joseph Duncan of County aforesaid Whereas the said Francis Browning deceased in his lifetime became seized in fee simple of a tract of land whereon said Joseph Duncan now lives containing One hundred acres and bounded beginning at a red oad and hickory old Corners on the North side the Gourd Vine River Corner to James Pendleton and running up the said river North West to a poplar the Mouth of Corbin Branch Corner to John Washburn thence up the said Branch with Washburn's line North to two pines in the line of a Tract of land granted by Patent to Colonel Henry Willis now the said James Pendletons thence with his line East to the beginning and whereas the said Francis Browning in his last Will & Testament among records of the said County Court of Culpeper directed that all his Estate both real and personal should be sold by his Exors at the death of the said Frances his Widow and the money to be equally divided amongst all his children and Whereas the said Frances and her children did commence a Friendly Suit in the County Court aforesaid whereby it was (by the consent of the parties) directed and ordered that all the Estate of the said Francis Browning deceased should be sold by Charles Browning and said Frances Browning as Administratrix under the Will and that they convey the same to the purchasers Whereby and by force of which decree they are impowered to convey the said land to the said Joseph Duncan Now this indenture witnesseth that the said Charles Browning and Frances Browning for the sum of Ninety pounds current money of Virginia hath sold unto the said Joseph Duncan One hundred acres of land...

This indenture made this 15th September 1777 Between Charles Browning Heir at Law, and Francis Browning Admr. with the Will annexed of Francis Browning deceased of one part and William Browning of Culpeper County of other part Whereas said Francis Browning in his life time among other things became possessed of land whereon the said Francis Browning and William Browning now lives containing Three hundred twenty four acres Whereof said William Browning became the purchases Bounded beginning at a white oak on the bank of Mill Run on the South side thereof and runs thence South to a hikory on a stony point thence North to two chestnuts on the bank of the river on the South side thereof thence up the several courses of the river to the mouth of Mill Run and thence up the courses of the Mill Run to the first begining and Whereas the said Francis Browning did by his Last Will in writing recorded in the records of the said County Court. Direct that all his Estate read and person should be sold by his Exrs. at the Death of said Frances his Widow and the money arising therefrom to be divided among all her children and whereas the said Frances and her children the heirs of said Francis Browning deceased did commence a suit in the said Court whereby it was by consent of the Parties decreed and ordered that all the Estate of Francis Browning deceased should be sold by the said Charles Browning as Heir at Law and the said Frances Browning as Admx. under the Will and convey the same to the Purchases whereby and by force of which decree they are Impowered to convey the said land unto William Browning relation had to said records & papers may appear Now this Indenture Witnesseth that said Charles Browning and Frances Browning for sum of Seventy five pounds current money of Virginia have sold unto the said William Browning the tract of one hundred fifty six acres of land...

In the Name of God Amen. I, Thomas Watts of the County of Culpeper being sick weak in body but of perfect soundness of memory do made and constitute this my last Will and Testament in manner and form following to wit. Item to my wife Ann Watts for and during the term of her natural life or widowhood I give one half of my land to include that part on which I now live but the decease of my said Wife my will and desire is that the above said half of my lands shall descend to my son Aron Watts and his heirs forever except one half acre which I reserve for a family burying place.

Item I give and devide to my son Robert Watts and his heir forever the other half of my lands and being that on which he now lives and I likewise give to my said Son Robert one bay mare called Polly together with her colt.

Item I give to my granddaughter Prissey Watts one feather bed and furniture belonging thereto.

Item my will and desire is that my just debts be paid out of the money which French Strother owes me being Eighteen pounds with Interest and that what may remain after paying said debts be equally divided betwixt my three children Viz. Aron Watts, Eleanor Morriss and Robert Watts.

Item I give to my wife Anne Watts all my other personal estate for and during her natural life or widowhood and at her decease it is my will and desire that the above mentioned personal estate be equally divided amongst my three children mentioned Viz. Aron Eleanor and Robert and lastly I do appoint my son Robert Watts Executor of this my last
Will and Testament. In Witness whereof I have hereunto set my hand and seal this twenty second day of April on thousand seven hundred and ninety six.

During its session begun in October 1780 the General Assembly passed an act designed to fill the state’s quota of troops for the Continental Army by drafting militiamen to serve for eighteen months. Culpeper County was required to supply 106 men. This was done by dividing the militia into 106 classes and drafting a man from each class by lot.

Summary  

The certificates issued by the commissioners of the provision law include date, a description of the item impressed including its value, and the name of the owner of the item. Court booklets and lists compiled by the county courts contain excerpts from the court proceedings and lists of authenticated certificates. The commissioner’s books recorded the date payment was authorized, the name of the claimant, and a description of the property.

Biog./Hist. Note  

During its session begun in May 1780 the General Assembly passed an act authorizing the governor to impress supplies needed by the American army. The governor appointed commissioners of the provision law in each locality to carry out the terms of the act. The commissioner, when he impressed property, gave the owner a certificate describing what was taken. Between 1781 and 1783 county courts held special sessions at which certificates were presented and authenticated, and booklets listing authenticated certificates were compiled and sent to Richmond for settlement. Two commissioners appointed to settle the claims recorded those for which they authorized payment, and warrants were issued by the auditor of public accounts.
